SUBJECT: Additional Approval/Permit Guide for LUFT/SCP Cases
ADDITIONAL APPROVALS, PERMIT GUIDE FOR LUFT/SCP CASES
Approvals issued by the caseworker to perform work associated with LUFT (leaking underground fuel
tanks) and SCP (Site Cleanup Program) cases are limited to approving the proposed activity as it relates to
the LUFT or SCP investigation and remediation.
Many of these activities require additional approvals or permits from agencies other than the LOP (Local
Oversight Program). The following information is provided to assist consultants and Responsible Party(ies) to be aware of other regulatory requirements that may pertain to your case. Your caseworker may require written confirmation that you have addressed each of these potential approvals/permits.
UHAZARDOUS MATERIALS/HAZARDOUS WASTE
If you will use or store hazardous materials at a site in quantities greater than or equal to 55 gallons of
liquids, 500 pounds of solids, or 200 cubic feet of compressed gases, even temporarily (for more than one
day), or if you generate any hazardous waste, you must file a Hazardous Materials Business Plan, pay fees,
and obtain a permit from Alameda County Department of Environmental Health’s Certified Unified
Program Agency (CUPA) or other local CUPA program, depending on the site location, prior to bringing such materials onsite. Hazardous materials include, but are not limited to, gasoline and diesel fuel, permanganate solutions, as well as storing contaminated groundwater, etc. Your caseworker can refer you to the appropriate agency to assist you. AIR EMISSIONS
If you will be emitting fumes or vapors from contaminated groundwater, or you will be operating
equipment that burns gasoline or diesel fuel, you may need a permit from the Bay Area Air Quality

GROUNDWATER DISCHARGE if you will be discharging groundwater to a sanitary sewer, a storm sewer, creek, river, or lake, or if you will be re‐injecting back into the ground, you may need a permit from the Regional Water Quality Control Board, the local Water Pollution Control Plant, and or the local Clean Water Program.
CONSTRUCTION
if you will be installing equipment or a building a structure, such as a canopy, or if installing piping to carry
groundwater or hazardous materials, you may be required to obtain a building, electrical, plumbing or
other permit from the local city or from Alameda County.
OTHER
There may be other approvals or permits required based upon the work you intend to perform. Your
caseworker may be able to assist you.
